Gammie Noel offers this website, including all information, products, services, tools, and features available through this site, conditioned upon your acceptance of these Terms of Service and all policies referenced herein.

By accessing our website, creating an account, placing an order, purchasing merchandise, or otherwise using our website or services, you agree to these Terms of Service (“Terms”).

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not use our website or purchase products through it.

Our online store is hosted on Shopify, which provides the e-commerce platform that enables us to offer products and services to customers.

1. Eligibility & Online Store Terms

By using this website, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have permission from a parent or legal guardian where required.

You may not use our website, products, or services for any illegal, fraudulent, or unauthorized purpose.

You must not transmit viruses, malware, malicious code, or other harmful material through our website.

We reserve the right, subject to applicable law, to refuse service, restrict access, cancel transactions, or take other reasonable measures when necessary to prevent fraud, abuse, unlawful activity, security threats, or violations of these Terms.

We make reasonable efforts to accurately describe and display our merchandise.

However, product colors and appearance may vary depending on your device, screen settings, photography, lighting, manufacturing variations, and other factors.

Measurements and sizing information are provided as guides unless expressly stated otherwise. Reasonable variations may occur.

All merchandise is subject to availability.

3. Placing & Accepting Orders

Submitting an order through our website constitutes an offer to purchase and does not necessarily mean that Gammie Noel has accepted the order.

An automated order confirmation generally confirms that we received your order. It does not necessarily constitute final acceptance of the order.

To the extent permitted by applicable law, Gammie Noel may accept an order when we begin fulfillment or shipment.

We reserve the right to reject or cancel an order before acceptance for legitimate reasons, including:

Merchandise being unavailable;
Pricing or product-information errors;
Payment authorization problems;
Suspected fraud;
Suspected unauthorized transactions;
Technical or website errors;
Suspected promotional abuse;
Attempts to circumvent quantity restrictions;
Suspected unauthorized resale; or
Other circumstances that reasonably prevent us from fulfilling the transaction.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

Nothing in this section limits rights that cannot legally be restricted.

4. Pricing, Typographical & Technical Errors

We make reasonable efforts to provide accurate pricing, product information, inventory information, promotional terms, and other website content.

However, errors may occasionally occur.

Incorrect discounts;
Incorrect promotional calculations;
Typographical errors;
Product-description errors;
Incorrect inventory information;

Where permitted by law, Gammie Noel reserves the right to correct an error and refuse or cancel an affected order.

An automated order or payment confirmation does not require Gammie Noel to honor an obvious or unintended pricing, promotional, or technical error where applicable law permits cancellation.

If an affected order has already been charged and we cancel it, we will issue an appropriate refund.

5. Customer Information

You agree to provide current, complete, and accurate information when placing an order.

This includes your:

Name;
Billing information;
Shipping address;
Email address;
Telephone number, when requested; and
Payment information.

You are responsible for reviewing your order information before submitting your purchase.

If you discover an incorrect shipping address or other error after placing an order, contact rhonda@gm-noel.com immediately.

We will make reasonable efforts to assist, but we cannot guarantee that shipping addresses, products, quantities, sizes, colors, or other order information can be changed once processing or fulfillment has begun.

6. Payments

By submitting payment information, you represent that you are authorized to use the payment method provided.

Payments may be processed through Shopify or other third-party payment providers.

Your use of a payment provider may also be subject to that provider's applicable terms and policies.

We reserve the right to decline or cancel transactions when a payment cannot be authorized or when there is reasonable evidence of fraud or unauthorized payment activity.

7. Purchase & Quantity Limits

Gammie Noel may establish reasonable purchase limits on particular merchandise, promotions, releases, or transactions.

Where permitted by law, limits may apply per:

Customer;
Household;
Customer account;
Email address;
Shipping address;
Billing address;
Payment method; or
Order.

We may cancel or reduce quantities when we reasonably determine that multiple transactions were used to circumvent a clearly disclosed purchase limit.

8. Resale

Unless expressly authorized by Gammie Noel, our website is intended primarily for purchases by end consumers.

We reserve the right, where permitted by law, to refuse or cancel orders that we reasonably determine are being placed primarily for unauthorized commercial resale, particularly where such purchases interfere with purchase limits, promotions, inventory availability, or normal retail operations.

9. Promotions, Discounts & Promotional Abuse

Promotional codes, discounts, bundles, free gifts, BOGO offers, giveaways, and other special offers may be subject to additional terms disclosed with the promotion.

Unless otherwise stated, promotional offers:

Cannot be combined with other offers;
Have no cash value;
Cannot be applied retroactively;
May be limited by customer, household, account, address, or transaction; and
May expire or be discontinued according to their stated terms.

Customers may not intentionally manipulate promotions or technical errors to receive benefits for which they are not eligible.

Examples may include:

Creating multiple accounts to circumvent a stated one-per-customer promotion;
Repeatedly using a single-use discount;
Circumventing purchase limits;
Exploiting an obvious checkout or promotional error; or
Using false information to obtain a promotion.

Where permitted by law, we may cancel an order or adjust an improperly applied promotion when we have reasonable evidence of intentional promotional abuse.

If payment has already been collected for an order we cancel, an appropriate refund will be issued.

10. Shipping & Delivery

Customers are responsible for providing a complete and accurate shipping address.

Shipping, processing, and delivery dates are estimates unless expressly guaranteed.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather conditions, transportation disruptions, holidays, customs processing, government actions, or other events.

If an order is returned because of an incorrect or incomplete address, refusal of delivery, or failure to claim the package, the matter will be handled according to our Return & Refund Policy and applicable law.

Additional shipping charges may apply if a customer requests reshipment.

11. Packages Marked Delivered

If carrier tracking indicates that your package was delivered but you cannot locate it, please contact the shipping carrier and rhonda@gm-noel.com promptly.

We may ask you to reasonably assist with an investigation, which may include:

Confirming the shipping address;
Checking with household members or others who may have accepted the package;
Checking reasonable delivery locations around the property;
Reviewing carrier tracking information; and
Cooperating with a carrier claim or investigation.

A carrier's “delivered” status does not automatically determine the outcome of every missing-package claim.

Gammie Noel may review available tracking information, delivery records, carrier findings, customer communications, and other relevant information when evaluating the matter.

Nothing in this section limits rights available under applicable law.

12. Returns, Exchanges & Refunds

Returns, exchanges, damaged merchandise, Final Sale merchandise, refused packages, promotional returns, and refunds are governed by the Gammie Noel Return & Refund Policy.

Eligible return requests generally must be initiated within 14 days of delivery, subject to the eligibility requirements and exceptions contained in that policy.

Policy Priority

If there is an unintended inconsistency between these Terms of Service and our Return & Refund Policy regarding a return, exchange, refund, damaged product, Final Sale item, or return-shipping matter, the Return & Refund Policy will control for that specific issue, except where applicable law requires otherwise.

Nothing in either policy restricts rights that cannot legally be waived.

13. Order Cancellations & Changes

If you need to cancel or change an order, contact rhonda@gm-noel.com as soon as possible.

We cannot guarantee that an order can be canceled or modified once processing or fulfillment has begun.

If an order has already shipped, it generally must be handled under our Return & Refund Policy.

14. Chargebacks & Payment Disputes

If you experience a problem with an order, we encourage you to contact rhonda@gm-noel.com so we have an opportunity to investigate and resolve the issue.

Nothing in these Terms waives or restricts legitimate rights available through your bank, credit card issuer, payment provider, or applicable law.

If a chargeback, payment dispute, or similar claim is filed, Gammie Noel reserves the right to provide relevant information and documentation to the bank, payment processor, card issuer, or other appropriate party.

This may include:

Order records;
Transaction information;
Billing and shipping information;
Tracking information;
Delivery confirmation;
Return records;
Refund records;
Customer communications; and
Other documentation reasonably related to the disputed transaction.

We reserve the right to contest chargebacks or payment disputes that we reasonably believe are inaccurate, fraudulent, abusive, or inconsistent with the transaction records.

15. Fraud & Abuse

We reserve the right to investigate suspected fraud, theft, payment abuse, promotional abuse, return fraud, or other misuse of our store.

Where permitted by law and supported by reasonable evidence, we may:

Cancel an order;
Refuse a transaction;
Restrict future purchases;
Restrict return privileges;
Limit access to customer accounts; or
Take other reasonable measures necessary to protect Gammie Noel and its customers.

These provisions do not restrict legitimate consumer rights or legitimate payment disputes.

16. Customer Accounts & Account Security

If our website allows you to create a customer account, you are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate account information and promptly update information that changes.

You may not intentionally access another customer's account or attempt to bypass website security.

We reserve the right to suspend or restrict accounts where reasonably necessary to investigate suspected fraud, unauthorized access, security threats, or violations of these Terms.

Unless otherwise stated, content displayed through the Gammie Noel website—including our business name, logos, original photographs, product photography, graphics, artwork, written descriptions, website content, designs, and other original materials—is owned by, licensed to, or otherwise lawfully used by Gammie Noel.

You may not reproduce, copy, modify, distribute, publish, sell, commercially exploit, or create unauthorized commercial reproductions of protected Gammie Noel content without appropriate permission, except where permitted by applicable law.

You may not use Gammie Noel branding in a manner that falsely suggests sponsorship, affiliation, endorsement, or authorization.

Nothing in these Terms grants rights beyond intellectual property rights that Gammie Noel actually owns or is legally entitled to enforce.

18. Reviews, Photos & User-Submitted Content

If you voluntarily submit a review, photograph, testimonial, comment, feedback, suggestion, or other content, you represent that you have the right to submit it.

You may not submit content that:

Infringes another person's intellectual property rights;
Unlawfully violates another person's privacy;
Contains malicious software;
Is fraudulent or intentionally misleading;
Is unlawfully defamatory; or
Otherwise violates applicable law.

Where permitted by law and consistent with disclosures presented when the content is submitted, you grant Gammie Noel permission to use that content for legitimate business, website, and promotional purposes.

Fires or floods;
Widespread power or internet outages;
Major transportation disruptions;
Carrier disruptions;
Labor disruptions;
Government actions;
Public emergencies;
Supply-chain interruptions; or
Other comparable circumstances beyond our reasonable control.

When such an event occurs, we may reasonably extend affected processing or performance periods.

This section does not eliminate any refund, cancellation, delivery, or consumer rights that applicable law requires us to provide.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an “as is” and “as available” basis.

We do not guarantee that our website will always operate without interruption, delay, error, or security issues.

Nothing in these Terms excludes warranties, guarantees, statutory rights, or consumer protections that cannot legally be excluded.
